.... please, please, please, send in comments to the Department of Homeland Security (DHS) telling them you oppose the Real ID Act. The Department of Homeland Security does not want to hear from us, so they have made it as difficult as possible to send in comments. This is why EFF has the fax page up, and it's fairly easy. The ACLU has a pretty good page on how to submit comments too. It's pretty much the best we can do -- and this is why each comment is worth so much.
If you go to the stoprealidnow blog (one of the links I put up), you can link to that. Also you can link to the privacycoalition. EPIC is running that, and it's pretty good..... -

However, is this petition legally binding? If this is not a legally binding bill that could become law, there is essentially no difference between sending it and "just talking". Homeland security officials are not up for re-election. They are chosen by the President, or however that works. They are not like Congressmen who require our support or care what we think.
Ill send it, so you cant accuse me of not helping, but I seriously doubt they care what we think. That would be like sending a million letters to fox news telling them to stop their neo-con bias. I doubt it would phase them. -

To say that the formal commenting process is opaque would be an understatement.
Here's how the process works, and I"ll use Real ID as the example.
The Real ID Act of 2005 was passed by Congress as a rider to a "must pass" spending bill that would support the war in Iraq, as well as to send money to the tsunami victims.
Once passed, it needed a "rule" that would tell DHS how to implement the law. All proposed rules go through a public commenting period; the proposed rule can be adopted as is, or can be rejected. If rejected, it needs to be redrafted and sent out again for public comment.
In this case, DHS has a proposed rule out now, and the public comment period ends on May 8th. At the end of this comment period the rule can be adopted or rejected. The more negative comments DHS receives, the less likely it will be that the rule will be adopted.
Ultimately, the Real ID Act needs to be repealed, but that is a separate battle. Right now, we need to keep the rule from being adopted.
So, "legally binding" isn't really applicable here... The Real ID Act is already law. We need to keep them from implementing the law until Congress gets the backbone to repeal it. And with 20+ states expressing opposition to Real ID, and Montana flat out saying they won't adopt it, I think we have a chance to kill it. Public support will only make it easier for Congress to grow a backbone. :)

DHS has no power in decision-making about this policy.
They only want to collect information on dissidents and they are throwing out a hook using this poorly-constructed charade as justification.
Only your local congressperson and senator can collect your opinion in any manner that matters.
Individual state assemblies and senates can be reached also, as individual states (16 so far) continue to refuse it. -

I can understand why you wouldn't want to contact them. If this is an issue, please consider calling your congress people. The more they hear from us the better. Again, it's about helping them have a backbone. Also, if you want, comments can be filed anonymously.
And a small thing about collecting information on dissidents -- Real ID will be a data collection nightmare. Because of the lack of any privacy protections, and the open hostility toward encryption of the data in the 2D bar code, any government agency or corporation with a reader can get at your data.
Please think about that as you weigh whether or not to contact your congress people.

I agree. This is a total waste. A nice thought, but they are not the ones who decide policy on this issue. If you are not directing this towards the policy makers, then you are at best wasting your time, and at worst going to end up on a data base and STILL not accomplish anything. -

Here's how it works -- and I have to do stuff like this more often than I care to really think about.... ;)
DHS drafted the current proposed rule to implement the Real ID Act. If no one says anything during the comment period, DHS will say that the public is fine with Real ID, and fine with all of the privacy invasive decisions contained in their draft rule.
If we get many people to comment, and the comments are all (or mostly all) negative, they can't say we don't care, and certainly can't say that we approve of their bad privacy and security decisions.
Either way, DHS **is** responsible for coming up with the rule that implements the Real ID Act. No one else has the responsibility to do this. If this rule is not adopted, DHS has to go back to the drawing board and come up with another draft rule. If that happens, we have another 30 or 60 days to try to convince Congress to repeal the law.
And make no mistake about it -- the states are very leery about implementing the Act. Some of the states care about the privacy and security issue, most all of them care about the cost issue. $20 billion is a lot of money.
So, it's most definitely NOT a waste.
I've seen these campaigns work before. The biggest one I've seen involved Secure Flight -- a passenger profiling system that the US wanted.
DHS and DoT published a draft rule in the Federal Register and it was practically in code. No where in the notice was Secure Flight mentioned. We had to figure it out, and we did. We commented it to death, we hit all of the press we could, and basically forced them to convene a committee (DHS put it together). A scathing report was issued, and guess what? Secure Flight was killed. It's still dead.
We still have CAPS, and terrible as it is,it's not as bad as Secure Flight. At one point, Secure Flight would have required credit checks and criminal background checks of everyone before you could fly. Can you imagine? Even to the end, they wanted to color code everyone (red=no fly, yellow=search till within an inch of your life, green= good to go).
But this is why I see Real ID as winnable. I've seen this pattern before.... -

I'm optimistic about this, I really am. And, I've been at a conference all week (Computers, Freedom, and Privacy - bunch of lawyers, policy people,and techies go) and people are generally optimistic about it. Of course, it all depends on how vocal we can all be (comments, talking to congress people, etc). -

I was just exchanging some email with one of my EFF friends and they've had about 2,500 faxed comments in already. DHS takes a while to get them all posted, and all of them are not yet on the site.
I haven't spoken yet to the ACLU, or some of the others that are in the coalition, but as soon as I do, I'll post another update.
